A “personal injury” claim is a legal claim arising from physical mental, and.or emotional harm caused to an individual by another person’s negligence, recklessness, or intentional wrongdoing. A “wrongful death” claim is a legal claim arising from the same sorts of circumstances, but resulting in the death of the party harmed.
Mr. Bergmann is well-qualified to serve clients in this area of practice having handled hundreds of such cases. Before forming this firm, Mr. Bergmann worked for more than a decade for a law firm which was regularly hired by major insurance companies to defend their insureds in personal injury and wrongful death cases. From that experience, Mr. Bergmann gained valuable insights into how insurance companies evaluate claims and, in the event of litigation, what their defense attorneys are likely to argue.
Mr. Bergmann will conduct an initial claim consultation at no charge for anyone who believes he or she has a personal injury or wrongful death claim. If, after conducting that consultation, Mr. Bergmann concludes that there is legal merit to the prospective client’s claim, he will ordinarily offer to undertake that person’s representation on a “contingency fee” basis. Under such an arrangement, the parties agree that (1) Mr. Bergmann will be paid for his services a percentage of any compensatory damages recovered for the client (either through settlement or litigation) and (2) if no recovery is made, the client will not owe him any other compensation.
